1. Introduction

Midwest Service Bureau, LLC (“MSB”) is a Kansas-based debt collection agency specializing in the recovery of delinquent accounts across various industries, including healthcare and finance. By engaging MSB’s services, clients agree to the following terms and conditions.

2. Services Provided

MSB offers comprehensive debt collection services, which may include:

• Initial debtor contact via phone, mail, or electronic communication
• Negotiation of payment plans and settlements
• Skip tracing and debtor location services
• Legal action coordination when necessary
• Reporting to credit bureaus in compliance with applicable laws

3. Client Obligations

Clients engaging MSB’s services agree to:

• Provide accurate and complete information regarding debtor accounts
• Notify MSB promptly of any payments received directly from debtors
• Refrain from actions that may interfere with MSB’s collection efforts
• Comply with all applicable laws and regulations

4. Compliance and Legal Standards

MSB operates in accordance with:

• The Fair Debt Collection Practices Act (FDCPA)
• The Fair Credit Reporting Act (FCRA)
• Kansas Consumer Protection Act (KCPA)
• Other applicable federal and state laws

MSB is committed to ethical collection practices and prohibits any form of harassment, misrepresentation, or unfair practices in its operations.

5. Fees and Compensation

MSB’s compensation is typically based on a contingency fee structure, where fees are a percentage of the amounts successfully collected. Specific fee arrangements will be detailed in a separate agreement between MSB and the client.

6. Confidentiality

MSB maintains strict confidentiality regarding all client and debtor information. Personal and financial data are handled in compliance with applicable privacy laws and MSB’s Privacy Policy.

7. Limitation of Liability

MSB shall not be liable for any indirect, incidental, or consequential damages arising from its debt collection services, except where such liability is mandated by law.

8. Termination

Either party may terminate the engagement with written notice, subject to the terms outlined in the separate agreement between MSB and the client.

9. Governing Law

These Terms and Conditions are governed by the laws of the State of Kansas. Any disputes arising under these terms shall be resolved in the appropriate courts within Kansas.

10. Amendments

MSB reserves the right to amend these Terms and Conditions at any time. Clients will be notified of significant changes, and continued use of MSB’s services constitutes acceptance of the revised terms.
