Collections Process

First-Party vs. Third-Party Collection

First-party collection is performed in the creditor's own name (often early in the cycle), while third-party collection is performed by a separate agency after an account is delinquent. The distinction matters legally: the FDCPA governs third-party collectors, and consumers perceive the two differently.

What First-Party vs. Third-Party Collection means for creditors

MSB supports both models โ€” branded first-party early-out for softer, earlier outreach, and fully compliant third-party recovery for delinquent accounts โ€” so creditors can match tone and timing to each stage.

Legal reference: FDCPA applies to third-party collection (15 U.S.C. ยง 1692)

Midwest Service Bureau has recovered commercial, medical, utility, and government debt for creditors nationwide since 1970 โ€” on a no-recovery, no-fee basis. Questions about first-party vs. third-party collection or a portfolio you'd like reviewed? Call (800) 362-0272.
